Complex Commercial Litigation

We have significant experience and a record of success in resolving a broad variety of complex commercial and business disputes.

Our attorneys have won significant victories in cases involving business torts, unfair or deceptive trade practices and antitrust, securities fraud, professional liability, breaches of fiduciary duty, sophisticated contracts, and shareholder and partnership disputes. We have represented financial institutions and participants in the investment funds industry, public and private corporations, businesses and executives in all types of litigation, including high-stakes class actions and derivative litigation. We represent attorneys in partnership and other disputes, professional malpractice, and disciplinary matters, and we counsel attorneys in a wide variety of matters.

We practice in federal and state trial and appellate courts and before federal and state regulatory agencies like the Department of Justice, the Securities and Exchange Commission, the Federal Trade Commission and the Consumer Finance Protection Bureau. We also handle business arbitrations on a regular basis, including proceedings before the American Arbitration Association, JAMS and FINRA.

 

RESULTS

  • Secured summary judgment in favor of director of an Illinois insurance company in fraud and breach of fiduciary duty action seeking over $50 million in damages and successfully prosecuted indemnification action resulting in the court ordering award of more than $1.1 million of attorneys’ fees.
  • Successfully defended hedge fund in multi-million dollar FINRA arbitration challenging communications with potential investors, securing an order dismissing all claims with prejudice.
  • Obtained dismissal of tortious interference with contract claim against a nationwide commercial real estate developer in action seeking over $60 million damages.
  • Successfully represented shareholder of closely-held Illinois corporation in action seeking involuntary dissolution; court-ordered auction results in shareholder receiving over $15 million for his interest in the company.
  • Secured dismissal of multi-million dollar breach of fiduciary duty and tortious interference with contract claims against director and investment manager of defunct hedge fund brought by a disgruntled investor.
